Governor Matt Bevin has joined with a 17-state coalition led by Texas Attorney General Ken Paxton to urge the US Department of Labor to rescind the Obama-era Persuader Rule. In a letter address to Secretary of Labor Alexander Acosta, the coalition stated that the current statute entitled “Interpretation of the ‘Advice’ Exemption in Section 203© of the Labor-Management Reporting and Disclosure Act,” or the Persuader Rule, to be incompatible with the Act itself. The reinterpretation of the rule would have potentially required attorneys to breach attorney-client privilege and made it more difficult and expensive for small-businesses to obtain legal advice.
