Beshear, Attorneys General Seeking to Intervene in Dismantling of Affordable Care Act

A group of state attorneys general, including Kentucky Attorney General Andy Beshear, is joining together to protect the nation’s health care system by seeking to intervene in and combat a lawsuit aimed at dismantling the Affordable Care Act. The lawsuit claims that the ACA is unconstitutional because the Tax Cuts and Jobs Act eliminated the ACA penalty for failing to purchase health insurance, known as the individual mandate. The lawsuit, filed in a Texas federal court in late February, seeks to invalidate the entire ACA on this basis. Beshear said Kentucky stands lost a projected $49.7 billion in federal funding for expanded Medicaid and subsidies for those on the individual market if the lawsuit moves forward, putting hundreds of thousands of Kentuckians at risk of losing health care coverage.
