On Friday, February 15, 2019 the House Democratic Caucus signed on as co-sponsors of state Representatives Derrick Graham and Joe Graviss’ House Bill 401, which would officially remove last year’s public-pension bill from state statute. Although the 2018 law was unanimously struck down by the Kentucky Supreme Court in December, its language remains on the books. Senate Bill 151 originally dealt with sewage before it was replaced with the pension language and then passed by the General Assembly in less than seven hours. In the Kentucky Supreme Court ruling against it, the justices said it violated constitutional requirements designed to give the public more notice of bills about to pass. House Bill 401 will be considered during the current legislative session.
