Judge Issues Temporary Restraining Order on Bills Seeking Abortion Ban in Kentucky

On Friday, March 15, 2019, US District Judge David Hale issued a temporary restraining order requested by the American Civil Liberties Union in regards to two Kentucky bills looking to ban abortion. Senate Bill 9 would ban abortion after six weeks, and House Bill 5 would ban abortions based on the unborn’s “sex, race, color, national origin, or disability,’ with the practicing physician having their license revoked. In the restraining order, Judge Hale said Senate Bill 9 challenged the right to privacy in the Due Process Clause of the Fourteenth Amendment, including “the right to choose to have an abortion, subject to certain limitations.” The restraining order will be in effective for 14 days from its entry, unless extended by subsequent order.
