Northern Kentucky Student Sues Health Department, Claims First Amendment Violation

A student in Walton, Kentucky has sued has the Northern Kentucky Health Department claiming a violation of First Amendment rights. The lawsuit stems from a senior student, identified as 18-year-old Jerome Kunkel, being barred from playing basketball at Assumption Academy after the Health Department issued a statement following an outbreak of chickenpox that unvaccinated students could not attend school until 21 days after the onset of rash for the last ill student or staff member. Extracurricular activities were canceled. Kunkel claims the action violates his religious freedom as a Catholic, and vaccination would go against his beliefs as he alleges the vaccine contains “aborted fetal cells.”
