Judge Rules in Favor of Health Department in Vaccination Lawsuit

A Kentucky student has lost his lawsuit against the Northern Kentucky Independent District Board of Health. Jerome Kunkel, 18, had sued the district after he was banned from attending school and extracurricular activities due to not receiving a vaccine against chickenpox following an outbreak at Assumption Academy in Boone County. Kunkel claimed receiving the vaccine would violate his religious beliefs, as he believed the chickenpox vaccine contained aborted fetal cells. Boone County Circuit Judge James Schrand upheld the health department’s authority to implement rules to prevent the spread of disease.
